Terms of Display Services

1 .All of our firework display services are offered under the below terms:


1.1 All fireworks; the supply of Category 3 & 4 display fireworks (Category 4 fireworks are for professional use only).


1.2 Site survey; To survey the site, making recommendations on safe spectator zone, safety distances, fallout area, any potential mitigating factors as well as plan suitable products to use tailored to these points.


1.3 Risk assessment; To review all risks that may apply to the display and plan strategies to minimise those risks to the public, crew and property.


1.4 Method statement; To produce a site specific standard operating procedure and plan to execute the display safely.


1.5 Transport; The transportation of all fireworks, personnel and equipment to and from the display site in a safe and legal manner.


1.6 Labour costs; The total cost incurred to Best Fireworks UK staffing including wages plus other costs and expenses.


1.7 Materials and Equipment; Provide all materials and equipment required to produce the display.


1.8 Site set-up; The safe and organised set-up of all fireworks, equipment and pyrotechnic articles to be used for the display.


1.9 Pyrotechnics; Execute the fireworks display in a safe, professional and spectacular manner.


1.10 Music Soundtrack & Firework Choreography; When requested, Best Fireworks UK will provide fireworks choreography and a musical soundtrack although this may be at an additional cost.


1.11 Site Clearance; Sweep the area for any unfired and potentially live pyrotechnical items and tidy the firing site as much as is reasonably practicable according to the conditions on the day.


1.12 Insurance; Comprehensive Combined Insurance policy to the sum of £5million (Public Liability) and £10million (Employers Liability).


2. Payment


Unless otherwise agreed by both parties:
 
2.1 Deposits; A 20% deposit is required to secure your booking. The remaining balance is due no later than 14 days prior to your show date. If a show is booked within 7 days of the required date then the total quoted price of the display is required upon booking.


2.2 Payment Method; An invoice will be issued upon receipt of and deposit. Payment can be made by bank transfer or card payment.


2.3 All invoices issued are valued in UK Sterling and all inclusive


2.4 Non-payment; If payment terms are not met then Showtime Fireworks have the right to refuse the firing of the show.


3. Variations & Substitutions / Omissions
 
3.1 Substitutions and omissions; Best Fireworks UK reserve the right at any time to substitute and/or omit a pyrotechnic effect from a show which we feel may cause an unacceptable Health and Safety risk or is not available at that time. This decision is normally put into effect where excessive wind conditions may cause a health & safety hazard to people and/or buildings/property. In the majority of cases, substitutions are made rather than omissions and we would look to compensate the customer for any omissions.


4. Termination & Cancellation
 
4.1 Cancellation giving at least 28 days notice prior to the display date = 100% refund of deposits paid.


4.2 Cancellations giving 7-14 days notice prior to the date of the display = 50% of the total display fee will be refunded.


4.3 Cancellations on the actual day of the display and up to 7 days prior to the display = no refund will be offered but the display may be postponed to a mutually agreeable date.


4.4 If a show is not allowed to go ahead or cancelled by the venue for any reason outside of Best Fireworks UK control, and a suitable alternative venue or rescheduled date is not possible then the same conditions apply above as for a client cancellation.


4.5(a) If Best Fireworks UK make a decision on the day of your show, that your show cannot go ahead due to adverse weather conditions we will refund the cost of the display, however all attempts must be made to find a suitable date to reschedule the display.
 


4.5(b) Should the client cancel the display on the actual day of the show due to adverse weather before we commence setting up then no refund will be offered but the display may be postponed to a mutually agreeable date.


4.6 Best Fireworks UK will do all they can to ensure that a display goes ahead, however; We reserve the right to cancel without compensation on the grounds of safety. Best Fireworks UK personnel on site have sole responsibility for this decision.
Reasons for cancellation include inadequate safety distance, poor crowd control and/or lack of stewards, inadequate or non-existent safety line/fence, and livestock in close proximity to the display site.
 
Please Note: We have never had to cancel a display due to adverse weather conditions or any other reason and will always look to reschedule the display if at all possible.
We carry out a thorough site survey and risk assessment in the 1st instance and well in advance to ensure that any potential problems are discussed with the client prior to any monies changing hands and we always seek to come to an agreeable cancellation decision as early as possible to avoid any avoidable fees.
